Individual tax interpretation 2026 — protection, cost and the ORD-IN form

By Good Balance Expert TeamPublished Last updated

An individual tax interpretation is a written answer from the Director of National Tax Information (KIS) to the question of how tax regulations apply to a specific situation described by the taxpayer. Whoever follows it will not suffer negative consequences retrospectively, even if the authority later changes its view. In 2026, the fee is PLN 40 for each situation (actual state or future event) described in the application, and KIS has 3 months to reply.

What the protection means

The protection works when the taxpayer acts exactly as the interpretation indicates, and the interpretation is later amended, expires or is set aside by the court. According to the explanations on biznes.gov.pl, in such a case the tax office:

  • does not initiate fiscal-penal proceedings,
  • does not charge default interest,
  • does not draw negative consequences retrospectively — including when the interpretation was not taken into account in the tax-case ruling.

The taxpayer learns of the amendment or setting aside of the interpretation from an order. From that moment they should settle under the new position.

When the protection does not work

The interpretation protects only within the description that the taxpayer presented. The Director of KIS does not carry out evidentiary proceedings and takes the description as being in line with reality. If an audit shows that the facts were different, the interpretation ceases to matter. There is also no protection where a decision on tax avoidance, i.e. artificial actions without economic justification, has been issued in the matter, or where tax havens' preferences have been used.

Timing also matters. The fullest protection is given by an interpretation obtained before the event, i.e. concerning a future event. When the question concerns something that has already happened and the tax consequences arose before the interpretation was delivered, following it does not release the taxpayer from paying tax if the position is later changed — but it does protect from interest and fiscal-penal liability.

In what matters it is worth asking

An application may be filed by a natural person, a company and also an entity without legal personality, alone or jointly with other participants in the same matter. Typical situations in which an application is justified are:

  • reliefs requiring assessable conditions to be met, e.g. classifying a developer's income under IP Box;
  • choice of ryczałt rate for services on the border between several categories;
  • place of taxation of services provided to foreign counterparties;
  • costs of unusual nature, where authorities in different regions have assessed similar expenses divergently;
  • restructurings: transformation of a business, contribution in kind, sale of an enterprise.

An application may not concern provisions on the competence and powers of authorities or provisions aimed at preventing tax avoidance. It may also not be filed by a taxpayer whose case is already the subject of tax proceedings, a tax or customs-and-fiscal audit, or when the case has been resolved by a decision or order.

How to write an application that really protects

The standard form is ORD-IN, and for a joint matter of several entities — ORD-WS. If the description or position do not fit in the form, an ORD-IN/A or ORD-WS/A attachment is added. The application must contain:

  1. the type of tax and the specific provisions to be interpreted — with article, paragraph and point numbers;
  2. a description of the actual state or future event — complete, without wording such as "probably" or "perhaps", with a description of key contracts and invoices (the documents themselves are not attached);
  3. a closed question to which "yes" or "no" can be answered;
  4. own position — unambiguous, without alternatives, with a legal justification;
  5. a statement that no proceedings or audit is pending in the matter and no ruling has been issued;
  6. proof of payment of the fee.

The most common mistake is a description that is too general or omits an inconvenient detail. An interpretation issued on the basis of incomplete facts gives a false sense of security. The second mistake is an open question, e.g. "what taxes must I pay?", which KIS will not answer on the merits.

Example

A developer plans to take on, from January, an order to develop software with transfer of rights to the client and wants to tax the income at 5%. He files an application in October, describing a future event: the scope of work, the way of keeping records, provisions of the contract on copyright. He asks whether the income from this order will be income from a qualified intellectual property right. If the interpretation is positive and is issued before the first settlement, the protection will also cover the tax.

Fee, deadlines, filing

ElementRule in 2026
FeePLN 40 per actual state or future event; for a joint application — per interested party
Deadline to send the proof of payment7 calendar days
Time to issue the interpretation3 months from receiving the application; time to supplement any gaps is not counted
Supplementing gaps7 days from the summons
No reply within the deadlinethe applicant's position is deemed correct (tacit interpretation)
Appealto the provincial administrative court through KIS, within 30 days of delivery

An example of calculating the fee from the podatki.gov.pl portal: a joint application by two counterparties with three actual states costs PLN 240 (3 × PLN 40 × 2 entities).

The application reaches KIS through e-Urząd Skarbowy (the e-Tax Office), through the inbox at the KIS electronic delivery address, in person at KIS headquarters in Bielsko-Biała, or by post. When sending the application as an attachment to a general letter, it must be signed separately. The interpretation arrives on the account in e-Urząd Skarbowy, at the electronic delivery address or by post.

Other tools securing settlements

  • General interpretation — issued by the Minister of Finance when authorities apply the same provision divergently. It serves to unify practice, not to resolve a single case.
  • Tax explanations — the Minister's guidance on applying the regulations, e.g. on IP Box.
  • Binding rate information (WIS) — a decision confirming the VAT rate for a specific good or service.

Before filing, it is worth looking through the interpretations already issued in similar matters in the EUREKA system — this makes it possible to assess how KIS approaches a given problem.

How Good Balance can help

We prepare applications for an individual tax interpretation: description of the facts, questions and a position with justification, and after delivery we assess whether the interpretation calls for an appeal. If you first want to establish whether an application makes sense in a given matter, we invite you to a consultation.
