Check the PLN 10,813.50 quarterly limit, PIT and VAT rules and who it fits.","
Unregistered business activity (działalność nierejestrowana) is a simple form of earning income intended for natural persons who want to test a business idea or provide small-scale services without an entry in CEIDG (Poland's Central Register and Information on Economic Activity). From 1 January 2026, you may use it as long as revenue in any quarter does not exceed 225% of the gross minimum wage, i.e. PLN 10,813.50. The solution is designed for beginners, people earning on the side, and freelancers who do not want to immediately bear the cost of ZUS (Poland's social insurance institution) and the obligations of a fully registered business.

Who can run unregistered business activity in 2026

This form is available to a natural person who independently provides services or sells goods and simultaneously meets the two main statutory conditions. The first is the revenue limit — in 2026, you may not exceed PLN 10,813.50 in any quarter, which corresponds to 225% of the minimum wage set at PLN 4,806. The second condition relates to prior business history: during the previous 60 months the person concerned may not have run a registered business activity (a suspension of a CEIDG entry is treated as not conducting business).

Unregistered activity is also available to people who have never been listed in CEIDG. In practice, the solution is attractive for three groups:

people in regular employment who want to earn legally on the side — e.g. a teacher giving private lessons, a graphic designer taking occasional commissions, a fitness instructor running weekend classes;

students and people without stable employment who sell their own products, run social media profiles, write texts or translate;

future entrepreneurs testing the market — before deciding to set up a JDG (jednoosobowa działalność gospodarcza, Poland's sole proprietorship) or formally register one.

Which industries cannot be run without a CEIDG entry

Not every activity fits within the unregistered framework. The following are excluded:

regulated activity requiring a licence, permit or entry in the register of regulated activity — e.g. personal security, detective services, insurance brokerage, road transport;

activity carried out within a civil-law partnership (spółka cywilna);

professions for which special regulations require an entry in a separate register (e.g. tax advisory, medical services carried out as professional practice);

trading in excise goods and other industries specified by regulations as requiring registration.

A person who wants to provide such services must register a business straight away. Our team supports you in selecting the legal form as part of our sole proprietorship services.

How to calculate the limit and what to do once it is exceeded

The PLN 10,813.50 limit applies to revenue due in a given quarter, not to profit. Revenue is the sum of amounts due for goods and services sold (as shown on issued bills or invoices), without deducting costs. The limit also includes amounts not yet received from the client if they are due for sales in that month.

Exceeding the quarterly limit automatically triggers the start of a business activity. From the day the limit is exceeded, the natural person has 7 days to register in CEIDG. Revenue earned from the moment the limit is exceeded is treated as business revenue — subject to ZUS and the choice of a form of taxation. For this reason, it is worth monitoring sales on an ongoing basis, especially when a larger order approaching the threshold appears in a given quarter.

Example. Ms Anna sells handmade bags. In January 2026, she earns PLN 3,100, in February PLN 3,400, in March PLN 4,500. The quarterly total is PLN 11,000 — above the PLN 10,813.50 limit. From the day the limit was exceeded, Ms Anna has 7 days to register a JDG, and the excess revenue is already accounted for as business revenue.

Taxes and contributions in 2026

Unregistered business activity is settled under the tax scale (12% and 32%). You cannot choose ryczałt (lump-sum tax on recorded revenue) or the flat tax (podatek liniowy). Income (revenue after deducting documented costs) is reported once a year in the PIT-36 return, under the item "unregistered activity". There are no monthly or quarterly advance payments.

No ZUS contributions are paid at all — neither social nor health. The person running unregistered activity is not covered by ZUS insurance, which means that this period does not count towards their pension record on this basis (unless another insurance title runs in parallel, e.g. employment).

As for VAT, a person conducting unregistered activity is generally covered by the turnover-based VAT exemption up to PLN 240,000 in annual turnover. However, VAT registration is mandatory from the first sale when the activity concerns goods or services excluded from the exemption (e.g. consultancy, legal services, selling car parts or electronics online).

Record-keeping and consumer obligations

Keeping a simplified sales record is mandatory. In practice, a table with the date, sequential number, amount due and cumulative monthly total — on paper or in a spreadsheet — is enough. From this document, the taxpayer can see when they are approaching the limit.

At the customer's request, a bill or invoice must be issued. The consumer has the same guarantees as when buying from a business registered in CEIDG: warranty, 14-day withdrawal right for distance purchases (online store, telephone orders), information about the seller and contact details. Unregistered activity does not exempt you from consumer regulations or from RODO (the Polish name for GDPR) rules when processing customers' personal data.

When unregistered activity is not worthwhile

The model loses sense when revenue regularly approaches the limit and prevents scaling the service. It is also not worthwhile for people who want to provide the same services for a former employer — the regulations require a 60-month cooling-off period for the registered form, and in the case of unregistered activity the tax authority may treat such cooperation as a disguised employment relationship.

An entrepreneur with real costs (purchase of goods, materials, tools) often does better on a JDG under general rules, because in unregistered activity costs can be deducted but the tax effect is small compared with the constant risk of exceeding the limit. For people providing IT, marketing or consulting services, a better solution is often a straight-away CEIDG entry with ryczałt.

How Good Balance helps

The Good Balance team helps assess whether unregistered activity is the right path or whether it is better to set up a JDG or a company right away. As part of our sole proprietorship services we select the form of taxation, prepare documentation, and keep track of limits and deadlines. We also invite you to a legal and tax consultation before your first client pays their first invoice.
","2026-10-09"]
