After registering, the entity receives a NIP number preceded by the PL prefix and is listed in the EU VIES database. For intra-Community transactions, this formality is a condition for applying the 0% rate on an intra-Community supply of goods (WDT) and for correctly settling acquisitions.

Who must register as a VAT-UE taxpayer

Under Article 97 of the VAT Act, the obligation to register for VAT-UE arises for a Polish entrepreneur in three main situations — regardless of whether they are already an active VAT payer or benefit from the turnover-based VAT exemption:

before the first intra-Community acquisition of goods (WNT), if the annual value of WNT exceeds PLN 50,000 in the current or previous year; an entrepreneur exempt from VAT may also register voluntarily earlier;

before the first intra-Community supply of goods (WDT) from Poland to a buyer in another Member State — no threshold applies, registration is required from the first transaction;

before the first supply or acquisition of a service for which the place of taxation is the buyer's country (Article 28b of the VAT Act) — also with no amount limit.

VAT-UE registration is independent of the turnover-based VAT exemption with its PLN 240,000 limit (raised on 1 January 2026 from PLN 200,000). A non-VAT entrepreneur who, for example, buys advertising from Google Ireland or a cloud subscription from a German provider must obtain a VAT-UE number and settle VAT in Poland as the recipient of the service. They do not lose the domestic exemption — they settle only the import-of-services tax on a VAT-8 or VAT-9M return.

The VAT-R form step by step

The application is filed on the VAT-R form — the same form used to register an active domestic VAT payer. The process looks as follows:

Identification data — enter the NIP, company details and the address consistent with the CEIDG or KRS register.

Part C.3 "Information on the tax obligation regarding intra-Community transactions" — mark the fields corresponding to the planned operations: WNT, WDT, acquiring or supplying services under Article 28b, and the expected date of the first transaction.

Competent office — the application goes to the head of the tax office competent for the taxpayer (for natural persons — by place of residence; for companies — by registered seat).

Signature and submission — the form can be filed in person, by post or electronically through e-Urząd Skarbowy, the podatki.gov.pl portal, or alongside the CEIDG-1 application when starting a business. Electronic submission requires a trusted profile, e-ID or qualified signature.

VAT-UE registration is free of charge and the form itself requires no attachments. After entering the country and the number, the system responds: "number valid" or "number invalid". It is worth saving the confirmation — a screenshot or the generated confirmation with an identification number — because the lack of evidence that the buyer was active on the day of delivery is a common reason for the 0% rate on a WDT being challenged.

For bulk checks or in accounting systems, the VIES API interface can be used. In March 2026 they purchase a subscription to a project-management tool from a company in Ireland for PLN 1,200 net per month. Before the first invoice, they file VAT-R with Article 28b services ticked and receive the PL number. Each month they:

receive an invoice from Ireland without VAT, marked "reverse charge";

settle 23% VAT on the value of the service in Poland on a VAT-8 return and pay the tax by the 25th day of the following month;

report the transaction on the VAT-UE statement as an acquisition of a service under Article 28b;

remain subjectively exempt from VAT in their domestic activity, because the exemption is counted from sales, not from acquisitions.

How Good Balance can help

VAT-UE registration, the correct classification of transactions and timely returns are everyday work for our accounting team.
