From a tax point of view the creator provides a promotional service, and regular commissions are usually revenue from a business activity. The key questions are: whether a company has to be registered, who to invoice and how to treat VAT when the payer is foreign.

How the programme works and where the commission comes from

The seller lists a product in TikTok Shop and sets a commission rate for creators. The creator adds the product to their showcase, pins it to a video or shows it during a live stream. When a viewer buys the product in the app, the platform accrues the commission and, after the return window ends, pays it to the creator. Some brands also cooperate with creators directly: they send samples, offer a higher rate or a fixed fee for a piece of content.

A separate model is referring TikTok's advertising tool to companies. There the commission depends on the ad spending of the acquired client, not on product sales, but the tax effects are very similar.

Unregistered activity or a company

At the start, with small amounts, a natural person may settle commissions under unregistered business activity (działalność nierejestrowana). Conditions in 2026:

revenue in no quarter exceeds PLN 10,813.50 (225% of the minimum wage);

that person has not had a registered company for the past 60 months.

Once the limit is exceeded, there are 7 days to register in CEIDG (Central Register and Information on Economic Activity). Under unregistered activity, no social or health contributions and no monthly tax advances are paid; revenue and costs are shown in the annual return. More in the article on unregistered business activity.

Once commissions become a stable source of income, registering a sole proprietorship brings order to the paperwork and access to the start-up relief at ZUS (Social Insurance Institution). A form of taxation must then be chosen. The creator has few costs (equipment, lighting, editing), so often considers ryczałt (lump-sum tax on recorded revenue). The ryczałt rate depends on the classification of the service, and promotional and advertising services are classified in various ways — for larger amounts it is worth confirming it with an individual tax interpretation. The general rules are described in the article ryczałt and its rates.

Who to invoice

The invoice goes to the entity that actually pays the commission and with which the creator has an agreement. In the affiliate programme the terms are set out in the platform's rules: these must be checked to see whether the payer is a company from the TikTok group or whether the commission is settled on behalf of the seller. In direct cooperation with a brand, that brand is the party.

A practical checklist before the first invoice:

full name, address and VAT number of the payer from the rules or payout panel;

the period the commission relates to and the amount matching the panel report;

currency and conversion rate — with commissions in euro, revenue is converted to zloty under the rules for foreign-currency revenue;

a note on reverse charge where the service is taxed in the buyer's country.

VAT on commissions from a foreign company

A promotional service rendered to a company based in another EU country is as a rule taxed in the buyer's country, which settles VAT itself. The creator issues an invoice without Polish VAT with a "reverse charge" note and reports the service in the VAT-UE recapitulative statement.

Important: VAT-UE registration is required of businesses that provide services for which the recipient from another member state is the taxpayer. This also applies to creators using the turnover-based VAT exemption. Registration must be notified before the first such service is performed. Details in the article VAT-UE registration.

If the commission is paid by a Polish seller, settlement is domestic: a VAT-exempt creator issues an invoice or receipt without VAT, and an active VAT payer — an invoice with 23% VAT, in 2026 as a rule in KSeF.

Samples, gifts and barter

Products received from brands for review are not always tax-neutral. If a sample is remuneration for promotional content (e.g. the brand sends a product in exchange for a video), its value is in-kind revenue. In a business activity it increases the company's revenue, and in a business-to-business barter it may also require VAT settlement. It is worth keeping a simple log: what was received, from whom, in exchange for what content, what was the market value.

Example

A creator from Kraków starts cooperation in March. In the first quarter commissions amount to PLN 4,200, in the second PLN 9,800 — this stays within the limit for unregistered activity. In July, after a successful live stream, revenue in the third quarter passes PLN 10,813.50 in August. She has 7 days to register in CEIDG. Before the first invoice to a foreign company, she registers for VAT-UE, and commissions in euro are converted to zloty. From that moment she keeps revenue records and pays ZUS contributions, using the start-up relief.

What to watch out for

Exceeding the quarterly limit and failing to register on time.

Invoicing the platform when the payer is another entity in the group — the data must match the rules.

Omitting VAT-UE registration for services to foreign companies.

Marking sponsored content: consumer rules require the viewer to know the content is advertising.

No records of samples and barter.

How Good Balance can help

We help creators with sole proprietorship registration: we select PKD codes, the form of taxation and file the VAT-UE notification, and then handle settlements of platform commissions and brand cooperations.
","2026-10-09"]
