In 2026 the rules follow from the Act on the labour market and employment services of 20 March 2025: the entry costs PLN 1,000, the application is filed exclusively electronically, and the voivodeship marshal has 14 days to consider it. Running an agency without an entry carries a fine of up to PLN 100,000.

Which services require entry in the register

The Act treats employment agency activity as a regulated activity. An entry is needed in two areas:

Job placement: matching candidates for employers, helping jobseekers, as well as sending people to work for employers abroad, sending foreigners to companies operating in Poland, and running online bases of offers and candidates.

Temporary work: the agency is the employer (or principal) and sends such persons to perform tasks under the direction of the client, i.e. the user employer.

In the PKD 2025 classification, the first area usually corresponds to code 78.10.Z, and the second to 78.20.Z. However, the entry of the code in CEIDG or KRS does not replace the entry in the agencies register. We write more about choosing codes in the article on PKD codes.

Placement without an entry may be run, among others, by OHP (Voluntary Labour Corps), local government units, academic career offices of universities not operating in this scope on commercial basis, and associations and foundations that do not run business activity. An entry is also not required for sending people to internships and traineeships that are not paid work, nor for organising practical vocational training. Those entities must still have premises in which they serve clients.

Who can obtain the entry

An agency may be run as a sole proprietorship, a civil partnership or a commercial company. The entry may also be obtained by foreign entrepreneurs operating in Poland through a branch or company, and by EU/EEA firms that legally provide such services in their country; they must then indicate a person present in Poland authorised to represent them.

The applicant must not:

have tax or contribution arrears (ZUS, KRUS, Labour Fund, Solidarity Fund, FGŚP, PFRON and other funds, if payments were due);

be in liquidation or bankruptcy;

have managing or representing persons finally convicted of specified offences (among others, against employee rights, document authenticity, business conduct) or punished for specified petty offences;

have a final ban on running such activity or have been previously removed from the register for serious breaches;

operate without premises in Poland if they run temporary work, send people abroad or send foreigners to work.

Premises are not a formality: this is where the agency receives candidates and keeps the documentation, including personal files of temporary workers. This requires an amendment of the entry, another PLN 1,000 fee and a statement of two years of activity. Providing such services without meeting this condition is subject to the same penalty as operating without an entry — from PLN 3,000 to PLN 100,000. For many new agencies this means that the first two years must be based on candidates from Poland and the EU, or on foreigners with free access to the labour market.

Duties after obtaining the entry

Annual activity report for the voivodeship marshal by 31 January for the previous year (correction by 1 March). The action plan looks like this: register the company with codes 78.10.Z and 78.20.Z, lease office premises, gather certificates of no arrears and no criminal record for the management, pay PLN 1,000 and file the application for an entry covering both types of services. For the first two years the agency recruits candidates not requiring a work permit. After that time it files an application to amend the entry, pays the second fee and may begin sending foreigners, remembering legalisation duties for each of them.

How Good Balance can help

We help choose the legal form and register the company as part of the business and company registration service, prepare documents for the entry application and run the agency's accounting.
